<p class="dcr-s3ycb2">When he walked into a local Fred Meyer convenience store on 17 January to buy a ticket to play the Powerball, Shafii had a 1-in-292m chance of collecting the jackpot that he hit a day later.</p>
<p class="dcr-s3ycb2">Those are about the same odds as flipping a coin and having it land on the same side 28 times in a row, the Associated Press has estimated. He had a vastly better chance of being struck by lightning at some point in his life, with the National Weather Service estimating that people who live for about 80 years have a one-in-15,300 odds of enduring such an ordeal.</p>
<p class="dcr-s3ycb2">Nonetheless, the combination of numbers on Shafii&#x2019;s ticket &#x2013; 14, 31, 35, 64, 69, and a Powerball of 23 &#x2013; was a winning one. He subsequently chose to immediately receive his prize in one lump sum of $146.4m in cash after relevant tax deductions rather than collect the full amount through an annuity over 29 years.</p>
<p class="dcr-s3ycb2">He thus became one of only seven Powerball winners from Oregon since 2005. Only two of them have won larger jackpots, including Cheng &#x201C;Charlie&#x201D; Saephan, who in April memorably <a href="https://www.theguardian.com/us-news/2024/apr/30/oregon-man-powerball-lottery-winner-jackpot" data-link-name="in body link">claimed</a> a $1.3bn Powerball jackpot &#x2013; the most lucrative in Oregon &#x2013; amid a battle with cancer.</p>
<p class="dcr-s3ycb2">&#x201C;I am overjoyed to have won,&#x201D; Shafii <a href="https://www.powerball.com/beaverton-man-claims-328.5-million-powerball-jackpot" data-link-name="in body link">said</a> in his post-jackpot winning statement, distributed on Friday by Powerball officials.</p>
<p class="dcr-s3ycb2">The store where Shafii bought his lucky ticket earned a $100,000 bonus. <p class="dcr-s3ycb2">DraftKings declined to comment on the adverts. Shortly after the Guardian contacted the firm, however, the two ads were modified to remove mentions of these expectations.</p>
<p class="dcr-s3ycb2">VIP hosts appear &#x201C;financially motivated to keep people who are kind of considered high value engaged&#x201D;, said Cait Huble of the National Council on Problem <a href="https://www.theguardian.com/society/gambling" data-link-name="in body link" data-component="auto-linked-tag">Gambling</a>. <p class="dcr-s3ycb2">A handful of lawmakers on Capitol Hill have grown increasingly concerned by the industry&#x2019;s methods. &#x201C;Sports betting companies make a paltry pretense of stopping gambling addiction,&#x201D; Richard Blumenthal, the Democratic senator of Connecticut, said. &#x201C;They&#x2019;re failing to address the national gambling addiction crisis, because their profits take priority over people.&#x201D;</p>
<p class="dcr-s3ycb2">Current regulations, largely set at the state level, are &#x201C;falling woefully short&#x201D;, added Blumenthal, who has <a href="https://www.theguardian.com/us-news/2024/dec/22/congress-gambling-addiction-sports-betting" data-link-name="in body link">proposed a federal crackdown</a>.</p>
<p class="dcr-s3ycb2">Last March Blumenthal <a href="https://www.blumenthal.senate.gov/newsroom/press/release/ahead-of-march-madness-blumenthal-demands-sports-betting-companies-stop-targeting-problem-gamblers" data-link-name="in body link">sent a barrage of letters to firms</a> across the industry, demanding information on their marketing tactics, self-exclusion options and VIP programs. Customers selected for such programs are assigned a host and often rewarded with credits and merchandise if they keep using a certain operator&#x2019;s platform.</p>
<p class="dcr-s3ycb2">A string of high-profile cases have raised questions about the use of VIP practices by the fast-growing US sports betting industry. Firms are trying &#x201C;to make their players feel like they&#x2019;ve won something&#x201D;, Lisa D&#x2019;Alessandro, whose estranged husband bet more than 440% of his salary in 2023 as his gambling addiction spiraled, <a href="https://www.theguardian.com/us-news/ng-interactive/2025/feb/15/draftkings-lawsuit-sports-betting-addiction" data-link-name="in body link">told the Guardian recently</a>.</p>
<p class="dcr-s3ycb2">Her attorney Matthew Litt, who is representing several people suing gambling operators alleging that the companies and their VIP programs exploited their customers&#x2019; gambling issues and encouraged overspending, described the VIP host-player relationship as &#x201C;quasi intimate&#x201D;; one of his clients reported they were contacted by a VIP host up to <a href="https://www.courtlistener.com/docket/69213901/1/patel-v-fanduel-inc/" data-link-name="in body link">100 times a day</a>.</p>
<p class="dcr-s3ycb2">&#x201C;If you&#x2019;re in the throes of a gambling addiction, in most cases, nobody knows what you&#x2019;re doing except your VIP host,&#x201D; Litt said. &#x201C;You&#x2019;re in one of the darkest times in your life, and the most honest relationship you have is with this VIP host.&#x201D;</p>
<p class="dcr-s3ycb2">Such programs have already faced a regulatory crackdown in some markets, <a href="https://www.gamblingcommission.gov.uk/news/article/gambling-commission-new-rules-to-stamp-out-irresponsible-vip-customer" data-link-name="in body link">such as the UK,</a> where a report, <a href="https://www.theguardian.com/society/2020/jan/02/gambling-report-shows-industrys-reliance-on-loss-making-customers" data-link-name="in body link">uncovered in 2020</a>, revealed that VIP customers were more likely to be gambling addicts than regular customers, and found that while VIP users made up small percentages of the customer base, they accounted for a large percentage &#x2013; in one case, 83% &#x2013; of the deposits.</p>

<p class="dcr-s3ycb2">Responding to Blumenthal&#x2019;s questions about VIP programs, the companies insisted their programs were not designed to get frequent bettors to bet more, and were comparable to loyalty programs in other sectors. Industry sources often liken the VIP programs to loyalty programs from coffee shops, for example, where customers are offered a free drink after they buy 10.</p>
<p class="dcr-s3ycb2">But Brianne Doura-Schawohl, a problem gambling lobbyist, disagrees with this comparison. Gambling operators are &#x201C;not like Starbucks&#x201D;, she said. The products that they offer &#x201C;are addictive, they come with risk, and they result in harm for a percentage of the population&#x201D;, she added.</p>
<p class="dcr-s3ycb2">BetMGM&#x2019;s VIP program was &#x201C;designed to provide VIP customers with a personal elevated experience&#x201D;, Adam Greenblatt, the CEO of BetMGM, wrote to Blumenthal, &#x201C;similar to how other rewards programs offered by other industries provide elevated experiences to loyal customers&#x201D;.</p>
<p class="dcr-s3ycb2">Penn Entertainment, which operates ESPN Bet under a deal signed with Disney, said its VIP hosts were &#x201C;solely focused on providing elite customer service, not to encourage recurrent bettors to engage in irresponsible activity&#x201D;.</p>
<p class="dcr-s3ycb2">FanDuel&#x2019;s program offers &#x201C;an enhanced level of customer service to a small cohort of customers&#x201D;, it told Blumenthal, while Fanatics &#x2013; which stressed that it had &#x201C;never sought to induce its VIP customers to use any of its products irresponsibly&#x201D; &#x2013; said: &#x201C;Like most companies around the world, [Fanatics Betting and Gaming] has developed programs to reward and retain its valued customers.&#x201D;</p>
<p class="dcr-s3ycb2">DraftKings told the senator that its programs were &#x201C;not designed to get frequent bettors to continue to bet&#x201D;, adding that this would &#x201C;conflict with DraftKings&#x2019; commitment to responsible gaming&#x201D;. Instead, the company said, its VIP program was &#x201C;designed to enhance the experience of some of its customers and foster brand loyalty&#x201D;.</p>
<p class="dcr-s3ycb2">Caesars, Bet365 and Betfred did not respond to the senator&#x2019;s questions, his office said.</p>
<p class="dcr-s3ycb2">VIP hosts received responsible gambling training, the companies said, and monitor accounts to detect potential signs of problem gambling behaviour issues. The one-on-one relationships with the players make the hosts &#x201C;well-positioned&#x201D; to identify and report potentially problematic behavior, the companies said.</p>
<p class="dcr-s3ycb2">But while responsible gambling advocates agree human interaction can help with early identification of at-risk players, they are concerned about the impact the VIP programs are having on players, and a lack of transparency around the programs.</p>
<p class="dcr-s3ycb2">The responses from the betting companies should be &#x201C;taken with a grain of salt&#x201D;, Doura-Schawohl said. &#x201C;Actions speak louder than words,&#x201D; she added. &#x201C;And in this case all we have to go by right now is what we&#x2019;re seeing actually happen within the ecosystem.&#x201D;</p>
<p class="dcr-s3ycb2">While each operator has a different approach, Doura-Schawohl said she was aware of a number of companies that offer bonuses to their VIP hosts that are linked to how much and how often their customers gamble.</p>
<p class="dcr-s3ycb2">FanDuel reassured Blumenthal that its VIP hosts&#x2019; compensation &#x201C;is not impacted in any regard by how much individual customers wager&#x201D; and is &#x201C;only impacted&#x201D; by adherence to responsible gambling targets. In a statement to the Guardian, a company spokesperson, Chris Jones, added: &#x201C;Key account managers are not compensated nor measured based on a customer&#x2019;s gambling activity.&#x201D;</p>
<p class="dcr-s3ycb2">Betfred, BetMGM, Bet365, Caesars, DraftKings and Penn did not respond to inquiries from the Guardian.</p>
<p class="dcr-s3ycb2">One of the questions that went unanswered &#x2013; which preoccupies many of those worried by the impact of VIP programs on at-risk gamblers &#x2013; is how gamblers are assigned a host in the first place. <a href="https://www.casinoreports.com/vip-ecosystem-sports-igaming/" data-link-name="in body link">Reports suggest</a> eligibility may be linked to factors such as high engagement levels, significant deposit and wagering amounts, or in some cases, <a href="https://www.theguardian.com/society/2020/jan/02/gambling-report-shows-industrys-reliance-on-loss-making-customers" data-link-name="in body link">losing a substantial amount of money with one company</a>.</p>
<p class="dcr-s3ycb2">Someone who spends $25,000 in a month might &#x201C;get hit up to be a VIP&#x201D;, according to Doura-Schawohl, although she said she had also seen others courted &#x201C;long before they start spending large amounts of money, which is what leads us to criticize the behavioral tactics that are deployed by the industry&#x201D;.</p>
<p class="dcr-s3ycb2">For Fanatics, a broader business that also sells sports merchandise and memorabilia, becoming a VIP customer is not down to betting activity alone, the company said, but engagement across its entire platform. &#x201C;Like any business, we reward our most loyal customers with a more personalized and elevated experience,&#x201D; it said.</p>
<p class="dcr-s3ycb2">Joe Maloney from the American Gaming Association (AGA) &#x2013; a lobby group whose <a href="https://www.americangaming.org/directors/" data-link-name="in body link">members</a> include most major casino companies, including FanDuel and DraftKings &#x2013; echoed that VIP programs offered by gambling operators aim to provide &#x201C;bespoke and unique experiences&#x201D; for customers, and reward frequent visitors and foster customer loyalty, which he said can help prevent customers from switching to competitors &#x201C;or worse, a competitor in the illegal market&#x201D;.</p>

<p class="dcr-s3ycb2">The legal gambling industry is &#x201C;not interested and is not building a business on the backs of problem gamblers&#x201D;, Maloney added.</p>
<p class="dcr-s3ycb2">Since the supreme court&#x2019;s 2018 decision to expand legalized sports betting, online gambling has become legal in 39 states and DC, with Americans betting approximately $150bn last year &#x2013; a 24% rise from the previous year. Earlier this month, the AGA <a href="https://www.theguardian.com/us-news/2025/feb/08/super-bowl-online-bets-gambling" data-link-name="in body link">estimated that $1.39bn worth of legal bets</a> would be placed on the Super Bowl.</p>
<p class="dcr-s3ycb2">Legal gambling&#x2019;s rapid rise has fueled concerns around the potential social impact. The National Council on Problem Gambling <a href="https://www.ncpgambling.org/help-treatment/faqs-what-is-problem-gambling/" data-link-name="in body link">estimates</a> that about 2.5 million adults in the US meet the criteria for a severe gambling problem, and that an additional 5-8 million face mild or moderate gambling problems.</p>
<p class="dcr-s3ycb2">Huble, from the National Council on Problem Gambling, believes the US hasn&#x2019;t learned from previous experience in markets such as the UK, and the issues that arose.</p>
<p class="dcr-s3ycb2">It was &#x201C;unfortunate&#x201D;, Huble said, that the US wasn&#x2019;t proactively addressing issues that they know are going to be a problem by looking at countries where sports betting has been legal and part of the culture for longer. At the moment, she added, it feels like &#x201C;revenue is definitely prioritized over players&#x2019; wellbeing.&#x201D;</p>

<p class="dcr-s3ycb2">Campaigners say the regime has been a &#x201C;protective bubble&#x201D; for firms that may put gamblers at risk of harm.</p>
<p class="dcr-s3ycb2">The watchdog&#x2019;s supervision of betting brands is under scrutiny as it faces a legal claim filed in the high court last week by Annie Ashton, whose husband, Luke, took his life after becoming addicted to gambling. An inquest highlighted failings by the brand Betfair, which had failed to flag Luke Ashton as a problem gambler.</p>
<p class="dcr-s3ycb2">Betfair had been in special measures at the time of Ashton&#x2019;s death in April 2021, but this was only disclosed by the Gambling Commission after Ashton&#x2019;s inquest had concluded, in 2023. Betfair&#x2019;s failings had included inadequate identification of customers at risk of gambling harm. It also emerged that Betfair had voluntarily divested &#xA3;635,123 to charities to reduce gambling harms, as well as agreeing an improvement plan &#x2013; allowing it to avoid formal regulatory action.</p>
<p class="dcr-s3ycb2">This weekend, Annie Ashton called for the regulator to publish the number of firms it has put into special measures, the names of firms and the revenues surrendered.</p>
<p class="dcr-s3ycb2">&#x201C;This information should be public knowledge and it should be scrutinised,&#x201D; she said. &#x201C;In Luke&#x2019;s case, we now know Betfair was in special measures and the regulator should have been looking at them with even more scrutiny. Someone died under their watch.</p>
<p class="dcr-s3ycb2">&#x201C;The whole situation with Luke was completely avoidable when you start unpicking what happened. You start to see these errors allowing for deaths to occur and lessons are not being learned at all.&#x201D;</p>
<p class="dcr-s3ycb2">Contacted by the <em>Observer</em> last week, the Gambling Commission said it was unable to provide figures on the number of firms put into special measures in the last three years, or industry revenues surrendered for failings. It has previously refused a freedom of information request to identify the firms, saying it could jeopardise the willingness of companies to provide information on a voluntary basis.</p>
<p class="dcr-s3ycb2">Dan Webster, a solicitor at Leigh Day representing Annie Ashton, said: &#x201C;It&#x2019;s disturbing that gamblers can be using platforms but are not aware [the platforms] have been identified by the commission as failing to comply with standards which are in place to keep people safe.&#x201D;</p>
<p class="dcr-s3ycb2">The inquest into Luke Ashton&#x2019;s death found that gambling disorder was a contributory cause of death. A prevention of future deaths report issued by the coroner said Ashton had been assessed as &#x201C;low risk&#x201D; by Betfair and its algorithm to monitor gambling had failed to flag him as a problem gambler.</p>
<p class="dcr-s3ycb2">The deposits and losses made by Ashton were most intensive in the weeks leading up to his death, but he was only sent automated &#x201C;safer gambling&#x201D; emails <a href="https://www.theguardian.com/society/2025/feb/01/uk-betting-giants-under-fire-for-ads-targeting-at-risk-gamblers" data-link-name="in body link">without a personal intervention</a>. The firm was effectively rewarding Ashton for his increased gambling activity, with increased bonuses and free bets, according to the legal team representing his wife.</p>
<p class="dcr-s3ycb2">Richard Clarke, a managing director at Flutter UK and Ireland, the parent company of Betfair, told the inquest in June 2023 it had been a tragic outcome, but that the brand was confident it had met the regulatory standards at the time. The firm did not disclose during the hearing that it had been in special measures at the time of Ashton&#x2019;s death.</p>
<p class="dcr-s3ycb2">In its response to the prevention of future deaths report after Ashton&#x2019;s inquest, the Gambling Commission disclosed it had conducted an assessment in December 2020 of brands within the Flutter group, including Betfair, four months before Ashton&#x2019;s death. The brand was placed in special measures after the assessment indicated &#x201C;there were failings in the process for identifying potential harm and interacting with customers&#x201D;.</p>
<p class="dcr-s3ycb2">Betfair was removed from special measures in June 2021. The commission was informed of Ashton&#x2019;s death in July 2021, but considered the activity on his account was prior to the completion of the special measures process, and it would &#x201C;not be appropriate&#x201D; to take regulatory action.</p>
<p class="dcr-s3ycb2">In November last year, the watchdog reiterated its decision that it would not subject Betfair to a formal regulatory investigation, despite questions over the timing and effectiveness of the changes made by the firm while in special measures. Annie Ashton&#x2019;s claim in the high court for a judicial review seeks to overturn the watchdog&#x2019;s decision not to launch a regulatory investigation into Betfair over Ashton&#x2019;s death.</p>
<p class="dcr-s3ycb2">The claim states: &#x201C;There exist real concerns that the defendant [the Gambling Commission] is failing adequately to regulate operators in order to protect people from gambling-related harm, particularly in the most serious cases where individuals have died and where there is concern that operator conduct has played a role.&#x201D;</p>

<p class="dcr-s3ycb2">The Gambling Commission introduced its special measures regime in September 2020, under which firms can submit and agree an urgent action plan to rectify regulatory failings. Officials say the watchdog&#x2019;s special measures policy is a helpful tool, giving betting brands the chance to rapidly rectify regulatory failings in advance of formal action.</p>
<p class="dcr-s3ycb2">Firms can &#x201C;offer to divest any profits made from non-compliance&#x201D;, with the proceeds going to good causes. Special measures should only be implemented where &#x201C;there is no or limited risk of consumer harm&#x201D;, there is not a history of protracted non-compliance, and there is an acceptance of failings.</p>
<p class="dcr-s3ycb2">A spokesperson for the regulator said: &#x201C;The Gambling Commission does not automatically publish the outcomes of special measures activities given they are designed to give effect to swifter action on the part of the operator short of exercising formal regulatory powers.</p>
<p class="dcr-s3ycb2">&#x201C;Most regulators have a range of different interventions they can make, and also a threshold below which they do not routinely publicise interventions they may have made. The Gambling Commission has consistently published enforcement outcomes and there is a register available detailing these actions.</p>
<p class="dcr-s3ycb2">&#x201C;We extend our sincere condolences to the family and friends of Luke Ashton. In line with our statutory duties as the gambling regulator we will continue to take appropriate enforcement action where needed. The Commission&#x2019;s formal regulatory powers remain in place.&#x201D;</p>

<p class="dcr-s3ycb2">&#x201C;Unfortunately, due to live legal proceedings we are unable to comment any further at this time.&#x201D;</p>
<p class="dcr-s3ycb2">Webster from Leigh Day said he was not convinced the industry had made sufficient changes to prevent further harm to people who are at risk but not identified as vulnerable gamblers. Annie Ashton has also separately launched a negligence claim against Flutter over her husband&#x2019;s death. The firm is defending the claim, denying any breach of duties.</p>
<p class="dcr-s3ycb2">Webster said: &#x201C;We&#x2019;re not satisfied, based on the evidence heard at the inquest and information obtained subsequently, that any changes made by Betfair are sufficient to ensure that something like what happened to Luke won&#x2019;t happen again in future.&#x201D;</p>
